1. Services Provided

 

DMV PT LLC offers personal training services and online coaching, including but not limited to strength training programs, nutrition coaching, fitness supplementation recommendations, and physique posing instruction. The services you purchase are provided by DMV PT LLC and not by any specific coach or gym, including DMV Iron Gym LLC or DMV Iron Gym Rockville LLC.

 

- Trainer Assignments: You may choose a coach, but sessions can be used with any available coach at the respective service level you purchased.

 

- Coach Changes: If your assigned coach resigns, moves, or is otherwise unavailable, you will have the opportunity to choose a new coach or one will be assigned to you. DMV PT LLC will offer two complimentary sessions to help you decide on a new coach.

 

2. Acknowledgment of Risks

 

By participating in personal training services, you acknowledge the inherent risks of injury associated with fitness activities. DMV PT LLC is not liable for any injuries, illnesses, or impairments that may arise from following recommendations or participating in any training sessions.

 

3. Consultation with Healthcare Provider

 

You agree to consult with your doctor or healthcare provider before starting any fitness program, nutrition plan, or supplementation regimen to ensure that you are physically and emotionally capable of participating.

 

4. Payment Terms

 

- Pricing: All payments for services are due as per the terms outlined in your receipt of sale. Payments can be made in full or through monthly installments via cash, debit, or credit card.

 

- Payment Default: If payment is not received within 60 days of the due date, your account will be sent to collections.

 

5. Cancellation Rights

 

You may cancel your contract with DMV PT LLC under the following conditions:

 

- Right of Cancellation (3-Day Cancel): You may cancel your contract within three business days of purchase and receive a full refund of any payments made.

 

- Relocation or Business Closure: If the facility relocates or goes out of business and fails to provide comparable services within five driving miles of the original location, you may cancel the contract.

 

- Medical or Death: If you become physically unable to use the services for 30 or more consecutive days, or in the event of your death, you may cancel the contract with appropriate documentation from your doctor sent to ptinfo@dmvpt.com.

 

- Non-Refundable Services: All payments for services rendered, including personal training and fitness coaching, are non-refundable except in cases of military orders or medical incapacitation.

 

6. Personal Training Session Expiration

 

The expiration dates for purchased training sessions are as follows:

 

- 1 session: Expires in 2 months

- 4 sessions: Expires in 3 months

- 8 sessions: Expires in 4 months

- 12 sessions: Expires in 6 months

- 24 sessions: Expires in 9 months

- 36 sessions: Expires in 12 months

- 50 sessions: Expires in 12 months

 

Unused sessions will roll over until the expiration date, and sessions will only be deducted when you attend or cancel within the required 24-hour notice.

 

7. Appointment Cancellation Policy

 

To avoid being charged for a session, you must cancel at least 24 hours in advance. Sessions canceled with less than 24 hours’ notice will result in an auto charge, and the session will be deducted from your account. Refunds for late cancellations are at the discretion of the manager.

 

8. Photo/Video Release

 

By attending training sessions, you give DMV PT LLC permission to take photos or video recordings of you during your sessions. These materials may be used for promotional purposes, and you will not receive compensation for appearing in such media.

 

9. Personal Strength/Fitness Training

 

DMV PT LLC operates independently from DMV Iron Gym LLC. Neither DMV PT LLC nor DMV Iron Gym LLC is responsible for any physical or emotional harm resulting from personal training services.

 

10. Release and Indemnification

 

You release, indemnify, and hold harmless DMV PT LLC, DMV Iron Gym LLC, and DMV Iron Gym Rockville LLC from any claims, damages, losses, or actions arising from your participation in any training services or the recommendations provided by your trainer.

 

11. General Provisions

 

- Health and Medical Disclaimer: DMV PT LLC is not a medical provider. Always consult your healthcare provider before following any recommendations.

 

- Termination of Services: DMV PT LLC reserves the right to terminate services if you fail to follow the program or act inappropriately.

 

12. Governing Law

 

These Terms are governed by the laws of the state of Virginia and Maryland, and any disputes will be handled in the appropriate jurisdiction within the state.

 

13. Changes to Terms and Conditions

 

DMV PT LLC reserves the right to update these Terms and Conditions at any time. Users are encouraged to review this page periodically to stay informed of any changes.
